The Gillies Case

When James Gillies's case came up at the Court of Session in Scotland recently
the judges there decided that the Dept of Work and Pensions were correct in
assuming that doctors that do Tribunals and also do DLA medicals at people's homes
are impartial and will not be biased even when they are work colleagues of the
EMP doctor working from the same office in the same town with access to the
same medical records.

DLA Group have uncovered evidence to show that the same doctor mentioned in the
Gillies case was also involved in a Tribunal were a doctor that she worked with was being
investigated by the GMC at the time of a Tribunal.  
The GMC found the doctor to be negligent in his duties.
 This same doctor at the Tribunal then went on to
support her colleague knowing that he had been
found guilty by the GMC.

The final twist to this tale is that the Benefits Agency had been
informed by Sema of the procedings at the GMC against the EMP
but had failed to inform the Appeals Service of this,
either deliberately or by the usual ineptitude
or more likely by design.  Thus the Judiciary and Mr Gillies were deprived
of what may have been crucial evidence in deciding if these doctors are above suspicion.

Thats what passes for justice here today.
